Business news :Marker considers legal action against Salomon and Tyrolia

Marker announced last Friday, just before the ISPO show, that it was going to ask a German court to take action against Salomon and Tyrolia for alleged infringement of a utility patent granted last October and for unfair competition.

However, an official connected with the case said that Marker was not planning to ask for a preliminary injunction to ban the sale of the products of Salomon or Tyrolia.

At issue is mainly the lateral spring design of the “Duke,” a freeride ski binding introduced by Marker five years ago, which has been adopted with only small variations in the “Guardian” and “Adrenalin” bindings launched at ISPO one year ago by Salomon and Tyrolia, respectively.

A top executive of Amer Sports, which owns Salomon, said at this ISPO that he had no comment because he had not been informed about Marker’s legal action.
